Terms of Service

These Terms of Service govern your use of InstanceForge websites, dashboards, game servers, server setup services, support, and related services. By purchasing, accessing, or using InstanceForge, you agree to these terms.
1. Definitions
"InstanceForge," "we," "us," and "our" refer to InstanceForge. "Customer," "you," and "your" refer to the person or organization using our services. "Server" means a game server, instance, container, virtual machine, or related infrastructure set up or operated by us.
2. Services
InstanceForge provides game server hosting, automated setup, dashboard access, automatic backups, basic configuration, modpack installation, optional dedicated IPv4 service, and support. Features may vary by plan, game, modpack, server software, and third-party availability.
We may update, replace, suspend, or discontinue any feature when needed for security, stability, provider limitations, legal compliance, or abuse prevention.
3. Account and Contact Information
You must provide accurate contact and billing information. You are responsible for keeping your dashboard login link, account email, server access, and player administration permissions secure. If you believe your access has been compromised, contact us immediately at support@instanceforge.com.
4. Billing and Payment
Paid services are billed through Stripe or another payment processor we make available. Subscription services renew automatically until canceled. Prices, taxes, and available plans may change, but active customers will be handled according to the billing terms shown at checkout and in the billing portal.
You authorize InstanceForge and our payment processor to charge the payment method you provide for recurring subscriptions, add-ons, usage-based items, applicable taxes, and approved one-time services.
5. Refunds
New monthly server plans are eligible for a refund within seven days of the server being set up if the service cannot be made reasonably usable after you contact support. Refund requests must be sent to support@instanceforge.com.
Refunds are not guaranteed for policy violations, chargebacks, abuse, excessive resource use, third-party outages outside our control, custom work already performed, domain-related costs, dedicated IPv4 provider costs after assignment, or servers that were used normally during the refund period.
6. Cancellation
You may cancel a subscription through the billing portal or by contacting support. Cancellation stops future renewals; it is not automatically a refund request. Server data may be deleted after cancellation or non-payment, so download anything you need before canceling.
7. Dedicated IPv4 Add-On
Dedicated IPv4 service depends on third-party IP availability and network setup. If you purchase the add-on, your server may show a pending status until the address is assigned and routing is configured. Dedicated IPs remain controlled by InstanceForge or our infrastructure provider and may be replaced, reassigned, or removed when required for technical, billing, security, abuse, or provider reasons.
8. Modpacks, Mods, Plugins, and Third-Party Content
Minecraft, CurseForge, Modrinth, modpacks, plugins, server jars, launchers, and other game content are third-party materials. We do not own those materials and cannot guarantee every modpack will install, update, run, or remain available. Some packs require specific client versions, extra memory, disabled mods, manual fixes, or author-provided server files.
You are responsible for using third-party content in compliance with its license, terms, and the game's end user license agreement. We may refuse or remove content that is unlawful, abusive, infringing, unsafe, unavailable, or likely to harm the service.
9. Acceptable Use
You may not use InstanceForge services to:
- Violate any law, regulation, court order, or third-party right.
- Host malware, phishing, credential theft, botnets, exploit kits, or unauthorized scanning tools.
- Attack, disrupt, overload, or probe networks, systems, users, or services without permission.
- Harass, threaten, dox, exploit, or abuse others.
- Host sexually exploitative, hateful, violent extremist, fraudulent, or otherwise unlawful content.
- Bypass plan limits, memory limits, security controls, billing controls, or access restrictions.
- Run unrelated high-load workloads, file mirrors, proxies, VPNs, crypto mining, spam, or non-game services without written approval.
10. Resource Use and Fair Use
Plans include the resources shown at checkout. We may limit, throttle, migrate, suspend, or ask you to reduce excessive CPU, memory, disk, network, log, backup, or process usage that harms platform stability or other customers. Unlimited or generous features are subject to reasonable use.
11. Automatic Backups and Data
We may provide scheduled backups or restore assistance, but backups are not a substitute for your own copies of important worlds, configs, databases, or files. We do not guarantee that every backup will be complete, current, or recoverable. You are responsible for exporting important data before cancellation, risky changes, modpack changes, or destructive actions.
12. Support
Support is available at support@instanceforge.com. We try to help with setup, common configuration, modpack install issues, restarts, and dashboard problems. We may decline support for custom code, unsupported mods, abusive behavior, illegal content, external client issues, or requests outside the plan purchased.
13. Security and Access
We may access servers, files, logs, configs, backups, and metadata as needed to provide support, maintain the platform, investigate abuse, comply with law, or protect customers and infrastructure. You may not attempt to access another customer's server, account, files, IP address assignment, dashboard, or billing data.
14. Suspension and Termination
We may suspend or terminate services immediately for non-payment, chargebacks, abuse, security risk, illegal activity, excessive resource use, provider requirements, or violation of these terms. We may also remove specific files, mods, endpoints, IP assignments, or access permissions when needed to protect the service.
15. Third-Party Services
InstanceForge relies on third-party providers for payments, domain routing, IP assignment, server software, modpack catalogs, infrastructure, email, and other services. We are not responsible for outages, errors, fees, policy decisions, deleted files, API changes, or service limitations caused by third parties.
16. Disclaimers
Services are provided "as is" and "as available." We do not promise uninterrupted service, error-free operation, perfect performance, compatibility with every modpack or client, permanent availability of any endpoint, or preservation of all data.
17. Limitation of Liability
To the maximum extent permitted by law, InstanceForge will not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages, including lost profits, lost revenue, lost data, downtime, player loss, or community disruption. Our total liability for any claim is limited to the amount you paid to InstanceForge for the affected service during the one month before the event giving rise to the claim.
18. Changes to These Terms
We may update these terms from time to time. Updated terms will be posted on this page with a revised date. Continued use of the service after an update means you accept the updated terms.
